Los asentamientos israelíes , también llamados colonias israelíes , [1] [2] [3] [4] son las comunidades civiles construidas por Israel en todos los territorios ocupados por Israel . Están pobladas por ciudadanos israelíes, casi exclusivamente de identidad o etnia judía , [5] [6] [7] y se han construido en tierras que Israel ha ocupado militarmente desde la Guerra de los Seis Días en 1967. [8] La comunidad internacional considera que los asentamientos israelíes son ilegales según el derecho internacional , [9] [10] [11] [12] pero Israel lo niega. [13] [14] [15] [16] En 2024, la Corte Internacional de Justicia (CIJ) determinó que la ocupación de Israel era ilegal y dictaminó que Israel tenía "la obligación de cesar inmediatamente todas las nuevas actividades de asentamiento y de evacuar a todos los colonos" de los territorios ocupados. [17] La expansión de los asentamientos a menudo implica la confiscación de tierras y recursos palestinos, lo que lleva al desplazamiento de comunidades palestinas y crea una fuente de tensión y conflicto. Los asentamientos suelen estar protegidos por el ejército israelí y son con frecuencia focos de violencia contra los palestinos. Además, la presencia de asentamientos y carreteras de circunvalación exclusivas para judíos crea un territorio palestino fragmentado , lo que obstaculiza gravemente el desarrollo económico y la libertad de movimiento de los palestinos . En la actualidad, existen asentamientos israelíes en Cisjordania (incluida Jerusalén Oriental ), que la Organización para la Liberación de Palestina (OLP) reclama como territorio soberano del Estado de Palestina , y en los Altos del Golán , que son reconocidos internacionalmente como parte del territorio soberano de Siria . En enero de 2023, hay 144 asentamientos israelíes en Cisjordania, incluidos 12 en Jerusalén Oriental ; el gobierno israelí administra Cisjordania como el Área de Judea y Samaria , que no incluye Jerusalén Oriental. [29] Además de los asentamientos, Cisjordania también alberga más de 100 puestos de avanzada israelíes , que son asentamientos que no han sido autorizados por el gobierno israelí. En total, más de 450.000 colonos israelíes residen en Cisjordania, excluida Jerusalén Oriental, y otros 220.000 colonos israelíes residen en Jerusalén Oriental. [32] Entre 1967 y 1982, se establecieron 18 asentamientos en la península del Sinaí, ocupada por Israel en Egipto , aunque estos fueron desmantelados por Israel después del tratado de paz entre Egipto e Israel de 1979. Según el Cuarto Convenio de Ginebra , el traslado por una potencia ocupante de su población civil al territorio que está ocupando constituye un crimen de guerra , [34] [35] [36] aunque Israel cuestiona que este estatuto se aplique a Cisjordania. [37] [38] El 20 de diciembre de 2019, la Corte Penal Internacional anunció la apertura de una investigación de crímenes de guerra en los territorios palestinos . La presencia y la continua expansión de los asentamientos existentes por parte de Israel y la construcción de puestos de avanzada son criticadas con frecuencia como un obstáculo para la paz por la OLP, [39] y por varios terceros, como la Organización de Cooperación Islámica , [40] las Naciones Unidas (ONU), [41] Rusia, [42] [43] el Reino Unido, [44] Francia, [45] y la Unión Europea . [46] La ONU ha defendido repetidamente la opinión de que la construcción de asentamientos por parte de Israel en los territorios ocupados constituye una violación del Cuarto Convenio de Ginebra. [47] [48] [49] Durante décadas, Estados Unidos también designó a los asentamientos israelíes como ilegales, [41] pero la administración Trump revirtió esta política de larga data en noviembre de 2019, [50] declarando que "el establecimiento de asentamientos civiles israelíes en Cisjordania no es per se incompatible con el derecho internacional"; [51] esta nueva política, a su vez, fue revertida a la original por la administración Biden en febrero de 2024, clasificando una vez más la expansión de los asentamientos israelíes como "incompatible con el derecho internacional" y coincidiendo con las posiciones oficiales de los otros tres miembros del Cuarteto de Oriente Medio . Algunos observadores y palestinos utilizan ocasionalmente el término "colonias israelíes" como sustituto del término "asentamientos". [54] [55] [56] [57] Los asentamientos varían en carácter desde comunidades agrícolas y aldeas fronterizas hasta suburbios y barrios urbanos. Los cuatro asentamientos más grandes, Modi'in Illit , Ma'ale Adumim , Beitar Illit y Ariel , han alcanzado el estatus de ciudad. Ariel tiene 18.000 residentes, mientras que el resto tienen alrededor de 37.000 a 55.500 cada uno.
Los asentamientos tienen una dimensión económica, impulsada en gran medida por los costos significativamente más bajos de la vivienda para los ciudadanos israelíes que viven en asentamientos israelíes en comparación con el costo de la vivienda y la vida en Israel propiamente dicho. [58] El gasto gubernamental por ciudadano en los asentamientos es el doble del que se gasta por ciudadano israelí en Tel Aviv y Jerusalén , mientras que el gasto gubernamental para los colonos en asentamientos israelíes aislados es tres veces el promedio nacional israelí. En enero de 2023, había 144 asentamientos israelíes en Cisjordania , incluidos 12 en Jerusalén Oriental . [29] Además, hay más de 100 asentamientos ilegales israelíes (no autorizados por el gobierno israelí) en Cisjordania. En total, más de 500.000 colonos israelíes viven en Cisjordania, excluida Jerusalén Oriental, [60] [61] y otros 220.000 colonos judíos residen en Jerusalén Oriental. [30] [31]
Además, más de 20.000 ciudadanos israelíes viven en asentamientos en los Altos del Golán. [62] [63]
Después de la Guerra de los Seis Días de 1967 , Israel ocupó varios territorios. [64] Se apoderó del resto de los territorios del Mandato Palestino de Cisjordania, incluida Jerusalén Oriental , de Jordania , que había controlado los territorios desde la guerra árabe-israelí de 1948, y de la Franja de Gaza de Egipto , que había mantenido a Gaza bajo ocupación desde 1949. De Egipto, también capturó la península del Sinaí y de Siria capturó la mayor parte de los Altos del Golán , que desde 1981 han sido administrados bajo la Ley de los Altos del Golán .
Ya en septiembre de 1967, el gobierno laborista de Levi Eshkol fomentó progresivamente la política de asentamientos israelíes . La base para el asentamiento israelí en Cisjordania se convirtió en el Plan Allon , [65] [66] llamado así en honor a su inventor Yigal Allon . Implicaba la anexión israelí de partes importantes de los territorios ocupados por Israel , especialmente Jerusalén Oriental , Gush Etzion y el valle del Jordán . [67] La política de asentamientos del gobierno de Yitzhak Rabin también se derivó del Plan Allon. [68]
El primer asentamiento fue Kfar Etzion , en el sur de Cisjordania, [65] [69] aunque esa ubicación estaba fuera del Plan Allon. Muchos asentamientos comenzaron como asentamientos de Nahal . Se establecieron como puestos militares de avanzada y luego se expandieron y poblaron con habitantes civiles. Según un documento secreto que data de 1970, obtenido por Haaretz , el asentamiento de Kiryat Arba se estableció confiscando tierras por orden militar y presentando falsamente el proyecto como estrictamente para uso militar mientras que en realidad, Kiryat Arba estaba planeado para uso de colonos. El método de confiscar tierras por orden militar para establecer asentamientos civiles fue un secreto a voces en Israel durante la década de 1970, pero la publicación de la información fue suprimida por la censura militar . El gobierno del Likud de Menahem Begin, desde 1977, apoyó más los asentamientos en otras partes de Cisjordania, por parte de organizaciones como Gush Emunim y la Agencia Judía /Organización Sionista Mundial, e intensificó las actividades de asentamiento. [68] [73] [74] En una declaración del gobierno, el Likud declaró que toda la histórica Tierra de Israel es patrimonio inalienable del pueblo judío y que ninguna parte de Cisjordania debería ser entregada a un gobierno extranjero. [75] Ariel Sharon declaró en el mismo año (1977) que había un plan para asentar a 2 millones de judíos en Cisjordania para el año 2000. [76] El gobierno derogó la prohibición de comprar tierras ocupadas por israelíes; el "Plan Drobles", un plan de asentamiento a gran escala en Cisjordania destinado a impedir un estado palestino bajo el pretexto de la seguridad, se convirtió en el marco de su política. Desde 1967, los proyectos de asentamiento financiados por el gobierno en Cisjordania son implementados por la "División de Asentamientos" de la Organización Sionista Mundial . [79] Aunque formalmente es una organización no gubernamental , está financiada por el gobierno israelí y arrienda tierras de la Administración Civil para establecerse en Cisjordania. Está autorizada a crear asentamientos en Cisjordania en tierras que le otorga la Administración Civil. [65] Tradicionalmente, la División de Asentamientos ha estado bajo la responsabilidad del Ministerio de Agricultura. Desde los Acuerdos de Oslo, siempre estuvo alojada dentro de la Oficina del Primer Ministro (OPM). En 2007, se trasladó de nuevo al Ministerio de Agricultura. En 2009, el Gobierno de Netanyahu decidió someter todas las actividades de asentamiento a la aprobación adicional del Primer Ministro y el Ministro de Defensa. En la presentación del Acuerdo de Oslo II el 5 de octubre de 1995 en la Knesset, el Primer Ministro Yitzhak Rabin expuso la política israelí de asentamientos en relación con la solución permanente del conflicto. Israel quería "una entidad palestina, menos que un Estado, que fuera el hogar de la mayoría de los residentes palestinos que viven en la Franja de Gaza y Cisjordania" . Quería mantener los asentamientos más allá de la Línea Verde, incluidos Ma'ale Adumim y Givat Ze'ev en Jerusalén Oriental. Se deberían establecer bloques de asentamientos en Cisjordania. Rabin prometió no regresar a las líneas del 4 de junio de 1967. [80]
En junio de 1997, el gobierno del Likud de Benjamin Netanyahu presentó su "Plan Allon Plus", que prevé la retención de alrededor del 60% de Cisjordania, incluida la zona de la "Gran Jerusalén" con los asentamientos de Gush Etzion y Ma'aleh Adumim, otras grandes concentraciones de asentamientos en Cisjordania, todo el valle del Jordán, una "zona de seguridad" y una red de carreteras de circunvalación sólo para israelíes. En la Hoja de Ruta para la Paz de 2002, que nunca se implementó, se reconoció la creación de un Estado palestino. Se desmantelarían los asentamientos de avanzada. Sin embargo, aparecieron muchos nuevos asentamientos y se eliminaron pocos. La política de asentamientos de Israel no cambió. Se ampliaron los asentamientos en Jerusalén Oriental y el resto de Cisjordania.
Si bien según la política oficial israelí no se construyeron nuevos asentamientos, desde 2002 se establecieron al menos un centenar de puestos avanzados no autorizados con financiación estatal en el 60% de Cisjordania que no estaba bajo control administrativo palestino y el crecimiento de la población de colonos no disminuyó.
En 2005, los 21 asentamientos de la Franja de Gaza y cuatro del norte de Cisjordania fueron evacuados por la fuerza como parte de la retirada israelí de la Franja de Gaza , conocida por algunos en Israel como "la Expulsión". [33] Sin embargo, la población total de colonos siguió aumentando. [83]
Tras el fracaso de la Hoja de Ruta, surgieron varios planes nuevos para establecerse en importantes partes de Cisjordania. En 2011, Haaretz reveló el plan de la Administración Civil "Línea Azul" , escrito en enero de 2011, que tiene como objetivo aumentar la "propiedad estatal" israelí de las tierras de Cisjordania ("tierras estatales") y los asentamientos en áreas estratégicas como el valle del Jordán y la zona norte del Mar Muerto. [84] En marzo de 2012, se reveló que la Administración Civil a lo largo de los años había asignado de forma encubierta el 10% de Cisjordania para nuevos asentamientos. Ya se habían asignado nombres provisionales para futuros asentamientos nuevos o expansiones de asentamientos. El plan incluye muchos sitios palestinos edificados en las Áreas A y B. [85 ]
Históricamente, la tierra disponible para los habitantes palestinos de la Franja de Gaza ha sido limitada como resultado de la confiscación de tierras por parte de Israel y el establecimiento de asentamientos. El crecimiento de los asentamientos en la Franja de Gaza antes de 1977 fue limitado, ya que la política de contención del partido laborista israelí prefería el establecimiento de una serie de asentamientos a lo largo de la frontera de la Franja. En ese momento, existían seis asentamientos en la Franja: Kfar Darom, Netzarim, Morag, Eretz, Katif y Netzer Hazani. Con la entrada en vigor de las políticas sionistas revisionistas del partido Likud con el gobierno de Begin, la escala de expansión de los asentamientos aumentó, aunque las políticas básicas relacionadas con los asentamientos no cambiaron. En 1978, se habían construido trece asentamientos como parte de una zona de amortiguación a lo largo de la frontera sur de Gaza en Rafah. [86]
Las discusiones que tuvieron lugar en Camp David ese año en torno a la idea de una posible autonomía futura palestina desencadenarían un aumento de la expansión de los asentamientos en la Franja de Gaza, siguiendo la política israelí de establecer " hechos sobre el terreno ". La economista política Sara Roy describió esto como una política destinada a dificultar el establecimiento de un Estado palestino independiente. La ubicación y el tamaño de estos nuevos asentamientos contribuirían a aislar geográficamente a las comunidades palestinas entre sí. [86]
En los siete años transcurridos entre 1978 y 1985, el gobierno israelí confiscó 11.500 acres de tierra para el establecimiento de asentamientos. En 1991, la población de colonos en Gaza alcanzaría los 3.500 y en 1993 los 4.000, es decir, menos del 1% de la población de Gaza. La tierra disponible para uso de la comunidad de colonos judíos superaba el 25% de la tierra total de Gaza. La proporción de dunams por habitante era de 23 para los colonos judíos y de 0,27 para los palestinos. Comparando la superficie edificada disponible para cada uno de los dos grupos en 1993, la proporción es de 115 personas por milla cuadrada para los colonos judíos y más de 9.000 personas por milla cuadrada para los palestinos. Sara Roy estima que el aumento de la densidad de población palestina en Gaza debido sólo a las políticas israelíes fue de casi 2.000 personas por milla cuadrada en 1993. [86]

Si bien los asentamientos mantuvieron un sistema económico aislado, afectaron la economía de Gaza a través de la confiscación de tierras, el consumo desproporcionado de recursos locales como el agua, la negación abrumadora de oportunidades de trabajo y las grandes disparidades en la financiación (tanto privada como gubernamental) para el desarrollo económico. Algunos asentamientos son ciudades autónomas con una población estable de decenas de miles de personas, infraestructura y todas las demás características de permanencia. Algunos ejemplos son Beitar Illit (una ciudad de cerca de 45.000 habitantes), Ma'ale Adumim , Modi'in Illit y Ariel (casi 20.000 habitantes). Algunos son pueblos con estatus de consejo local con poblaciones de 2.000 a 20.0000, como Alfei Menashe , Eli , Elkana , Efrat y Kiryat Arba . También hay grupos de aldeas gobernadas por un comité elegido local y consejos regionales que son responsables de los servicios municipales. Algunos ejemplos son Kfar Adumim , Neve Daniel , Kfar Tapuach y Ateret . Los kibutzim y moshavim en los territorios incluyen Argaman , Gilgal , Na'aran y Yitav . Se han construido barrios judíos en las afueras de barrios árabes, por ejemplo en Hebrón . En Jerusalén, hay barrios urbanos donde conviven judíos y árabes: el Barrio Musulmán , Silwan , Abu Tor , Sheikh Jarrah y Shimon HaTzadik .
Según los Acuerdos de Oslo , Cisjordania quedó dividida en tres partes separadas, denominadas Área A, Área B y Área C. Dejando de lado la posición de Jerusalén Oriental, todos los asentamientos están en el Área C, que comprende aproximadamente el 60% de Cisjordania.
Algunos asentamientos se establecieron en lugares donde habían existido comunidades judías durante el Mandato Británico de Palestina o incluso desde la Primera Aliá o en tiempos antiguos. [89]
A finales de 2010, 534.224 judíos israelíes vivían en Cisjordania, incluida Jerusalén Oriental, de los cuales 314.132 vivían en los 121 asentamientos autorizados y 102 asentamientos no autorizados en Cisjordania, 198.629 vivían en Jerusalén Oriental y casi 20.000 vivían en asentamientos en los Altos del Golán.
En 2011, el número de colonos judíos en Cisjordania, excluida Jerusalén Oriental, había aumentado a 328.423 personas. [83]
En junio de 2014, el número de colonos israelíes en Cisjordania, excluida Jerusalén Oriental, había aumentado a 382.031 personas, con más de 20.000 colonos israelíes en los Altos del Golán. [100] [63]
En enero de 2015, el Ministerio del Interior israelí dio cifras de 389.250 ciudadanos israelíes viviendo en Cisjordania fuera de Jerusalén Oriental. [101]
A finales de 2016, la población judía de Cisjordania había aumentado a 420.899, excluyendo Jerusalén Oriental, donde había más de 200.000 judíos. [102]
En 2019, el número de colonos israelíes en Cisjordania, excluida Jerusalén Oriental, había aumentado a 441.600 personas, [30] y el número de colonos israelíes en los Altos del Golán había aumentado a 25.261. [32]
En 2020, el número de colonos israelíes en Cisjordania, excluida Jerusalén Oriental, habría aumentado a 451.700 personas, y otros 220.000 judíos viven en Jerusalén Oriental. [30]

Además de la migración interna, en grandes cantidades aunque en descenso, los asentamientos absorben anualmente a unos 1.000 nuevos inmigrantes de fuera de Israel. La organización estadounidense Kulanu trabaja con grupos de colonos israelíes de derecha como Amishav y Shavei Israel para asentar a judíos de color "perdidos" en las zonas donde los palestinos locales están siendo desplazados. [120] En la década de 1990, el crecimiento anual de la población de colonos fue más de tres veces el crecimiento anual de la población en Israel. [121] El crecimiento de la población ha continuado en la década de 2000. [122] Según la BBC, los asentamientos en Cisjordania han estado creciendo a una tasa del 5-6% desde 2001. [123] En 2016, había sesenta mil israelíes estadounidenses viviendo en asentamientos en Cisjordania. [124]
El establecimiento de asentamientos en los territorios palestinos está vinculado al desplazamiento de la población palestina, como lo demostró una Comisión del Consejo de Seguridad de 1979 que estableció un vínculo entre los asentamientos israelíes y el desplazamiento de la población local. La Comisión también concluyó que quienes permanecieron en el territorio estaban siendo constantemente presionados para irse y dejar sitio a más colonos a los que se estaba alentando a instalarse en la zona. En conclusión, la Comisión afirmó que los asentamientos en los territorios palestinos estaban causando "cambios profundos e irreversibles de naturaleza geográfica y demográfica". [125]
Los asentamientos israelíes en Cisjordania se encuentran dentro del distrito administrativo de la zona de Judea y Samaria . Desde diciembre de 2007, todas las actividades de asentamiento (incluida la planificación) en Cisjordania requieren la aprobación tanto del Primer Ministro como del Ministro de Defensa israelí. [126] La autoridad para la planificación y la construcción está a cargo de la Administración Civil de las Fuerzas de Defensa de Israel .
El área está formada por cuatro ciudades , trece concejos locales y seis concejos regionales .
El Consejo de Yesha ( en hebreo : מועצת יש"ע , Moatzat Yesha , un acrónimo hebreo para Judea , Samaria y Gaza ) es la organización paraguas de los consejos municipales de Cisjordania.
Según la ONG israelí B'Tselem , los edificios de los asentamientos israelíes cubren sólo el 1 por ciento de Cisjordania, pero su jurisdicción y sus consejos regionales se extienden a alrededor del 42 por ciento de Cisjordania. El presidente del Consejo de Yesha, Dani Dayan, cuestiona las cifras y afirma que los asentamientos sólo controlan el 9,2 por ciento de Cisjordania. [127]
Entre 2001 y 2007 se construyeron más de 10.000 unidades de asentamientos israelíes, mientras que se expidieron 91 permisos para construcciones palestinas y se demolieron 1.663 estructuras palestinas en la Zona C. [128]
Los casos de los palestinos de Cisjordania se juzgan en los tribunales militares de Israel, mientras que los colonos israelíes judíos que viven en el mismo territorio ocupado son juzgados en tribunales civiles. [129] El Comité de las Naciones Unidas para la Eliminación de la Discriminación Racial ha descrito este acuerdo como una "segregación de facto". [130] En 2012 se rechazó un proyecto de ley para extender formalmente la legislación israelí a los asentamientos israelíes en Cisjordania. [131] Las leyes militares básicas que rigen Cisjordania están influenciadas por lo que se denomina la "canalización" de la legislación israelí. Como resultado de la " ley de enclave ", grandes porciones de la legislación civil israelí se aplican a los asentamientos israelíes y a los residentes israelíes en los territorios ocupados. [132]
El 31 de agosto de 2014, Israel anunció que se apropiaría de 400 hectáreas de tierra en Cisjordania para albergar a 1.000 familias israelíes. La apropiación fue descrita como la mayor en más de 30 años. [133] Según informes de la Radio Israelí, la construcción es una respuesta al secuestro y asesinato de adolescentes israelíes en 2014. [ 133]
En marzo de 2024, durante la guerra entre Israel y Hamás , se anunció que Israel planeaba construir más de 3.300 nuevas viviendas en el asentamiento de Kedar y Ma'ale Adumim en Cisjordania. La expansión del asentamiento fue anunciada por el ministro de Finanzas israelí, Bezalel Smotrich, después de que tres palestinos abrieran fuego cerca del asentamiento de Ma'ale Adumim, matando a uno e hiriendo a cinco, y suscitando críticas de Estados Unidos debido al aumento de las tensiones. En la Ley de Jerusalén de 1980, Jerusalén Oriental se define como parte de Israel y su capital, Jerusalén . Como tal, se administra como parte de la ciudad y su distrito, el Distrito de Jerusalén . Los residentes de Jerusalén Oriental anteriores a 1967 y sus descendientes tienen estatus de residente en la ciudad, pero muchos han rechazado la ciudadanía israelí. Por lo tanto, el gobierno israelí mantiene una distinción administrativa entre ciudadanos israelíes y no ciudadanos en Jerusalén Oriental, pero la municipalidad de Jerusalén no lo hace.
Los Altos del Golán se administran de conformidad con la legislación civil israelí como subdistrito del Golán, parte del Distrito Norte . Israel no hace distinción legal ni administrativa entre las comunidades de los Altos del Golán que existían antes de 1967 (principalmente drusos ) y los asentamientos posteriores a 1967.
Después de la captura de la península del Sinaí de Egipto en la Guerra de los Seis Días de 1967, se establecieron asentamientos a lo largo del Golfo de Aqaba y en el noreste del Sinaí, justo debajo de la Franja de Gaza . Israel tenía planes de expandir el asentamiento de Yamit en una ciudad con una población de 200.000, [135] aunque la población real de Yamit no excedía de 3.000. [136] La península del Sinaí fue devuelta a Egipto en etapas a partir de 1979 como parte del tratado de paz entre Egipto e Israel . Como lo requiere el tratado, en 1982 Israel evacuó a la población civil israelí de los 18 asentamientos del Sinaí. En algunos casos, las evacuaciones se hicieron por la fuerza, como la evacuación de Yamit. Todos los asentamientos fueron entonces desmantelados.
Antes del plan de retirada unilateral de Israel , en virtud del cual se evacuaron los asentamientos israelíes, había 21 asentamientos en la Franja de Gaza bajo la administración del Consejo Regional de Hof Aza . La tierra se asignó de tal manera que cada colono israelí disponía de 400 veces la tierra disponible para los refugiados palestinos y de 20 veces el volumen de agua permitido a los campesinos de la Franja. [137]
En julio de 2024, la Corte Internacional de Justicia emitió una opinión consultiva histórica en la que afirmaba que la ocupación israelí de Cisjordania, Jerusalén Oriental y la Franja de Gaza era ilegal, que Israel tenía "la obligación de cesar inmediatamente todas las nuevas actividades de asentamiento y de evacuar a todos los colonos" de Cisjordania y Jerusalén Oriental, y que Israel debía "reparar los daños causados a todos" los habitantes de esas tierras. [17] [138] [139]
La opinión consensuada [140] en la comunidad internacional es que la existencia de asentamientos israelíes en Cisjordania, incluida Jerusalén Oriental , y los Altos del Golán, viola el derecho internacional. [141] El Cuarto Convenio de Ginebra incluye declaraciones como "la Potencia ocupante no deportará ni transferirá partes de su propia población civil al territorio que ocupa". [142] El 20 de diciembre de 2019, la fiscal jefe de la Corte Penal Internacional, Fatou Bensouda, anunció una investigación de la Corte Penal Internacional en Palestina sobre presuntos crímenes de guerra cometidos durante el conflicto israelí-palestino . [143] En la actualidad, la opinión de la comunidad internacional , como se refleja en numerosas resoluciones de la ONU, considera la construcción y existencia de asentamientos israelíes en Cisjordania , Jerusalén Oriental y los Altos del Golán como una violación del derecho internacional. [144] [145] [146] La Resolución 446 del Consejo de Seguridad de la ONU se refiere al Cuarto Convenio de Ginebra como el instrumento jurídico internacional aplicable, y pide a Israel que desista de transferir su propia población a los territorios o cambiar su composición demográfica. La Conferencia de las Altas Partes Contratantes de los Convenios de Ginebra, que volvió a reunirse, ha declarado ilegales los asentamientos [147], al igual que el principal órgano judicial de las Naciones Unidas, la Corte Internacional de Justicia . [148]
La posición de los sucesivos gobiernos israelíes es que todos los asentamientos autorizados son completamente legales y compatibles con el derecho internacional. [149] En la práctica, Israel no acepta que la Cuarta Convención de Ginebra se aplique de iure , pero ha declarado que en cuestiones humanitarias se regirá de facto por sus disposiciones, sin especificar cuáles son. [150] [151] El erudito y jurista Eugene Rostow [152] ha cuestionado la ilegalidad de los asentamientos autorizados.
Según la legislación israelí, los asentamientos en Cisjordania deben cumplir criterios específicos para ser legales. [153] En 2009, había aproximadamente 100 [123] pequeñas comunidades que no cumplían estos criterios y se las denomina asentamientos ilegales . [154] [155] [156]
En 2014, doce países de la UE advirtieron a las empresas que no se involucraran en los asentamientos. Según las advertencias, las actividades económicas relacionadas con los asentamientos implican riesgos jurídicos y económicos derivados del hecho de que los asentamientos se construyen en tierras ocupadas que no están reconocidas como propiedad de Israel. [157] [158]
El consenso de la comunidad internacional –la gran mayoría de los estados, la abrumadora mayoría de los expertos legales, la Corte Internacional de Justicia y la ONU– es que los asentamientos violan el derecho internacional. [159] [160] Después de la Guerra de los Seis Días, en 1967, Theodor Meron , asesor legal del Ministerio de Asuntos Exteriores israelí, declaró en una opinión legal al Primer Ministro:
"Mi conclusión es que el asentamiento de civiles en los territorios administrados contraviene las disposiciones explícitas del Cuarto Convenio de Ginebra". [161]
Esta opinión legal fue enviada al Primer Ministro Levi Eshkol . Sin embargo, no se hizo pública en ese momento. El gabinete laborista permitió los asentamientos a pesar de la advertencia. Esto allanó el camino para un crecimiento futuro de los asentamientos. En 2007, Meron declaró: "Creo que yo habría dado la misma opinión hoy". [162]
En 1978, el Asesor Jurídico del Departamento de Estado de los Estados Unidos llegó a la misma conclusión. [154] [163]
La Corte Internacional de Justicia, en su opinión consultiva, ha dictaminado que Israel viola el derecho internacional al establecer asentamientos en el territorio palestino ocupado, incluida Jerusalén Oriental. La Corte sostiene que Israel no puede invocar su derecho de legítima defensa o la necesidad para imponer un régimen que viola el derecho internacional. La Corte también dictaminó que Israel viola los derechos humanos básicos al impedir la libertad de movimiento y el derecho de los habitantes al trabajo, la salud, la educación y un nivel de vida adecuado. [164]
Organizaciones internacionales intergubernamentales como la Conferencia de las Altas Partes Contratantes del Cuarto Convenio de Ginebra , [165] órganos principales de las Naciones Unidas , [166] la Unión Europea y Canadá , [167] también consideran que los asentamientos son una violación del derecho internacional. El Comité para la Eliminación de la Discriminación Racial escribió que "la condición de los asentamientos era claramente incompatible con el artículo 3 de la Convención, que, como se señala en la Recomendación General XIX del Comité, prohíbe todas las formas de segregación racial en todos los países. Existe un consenso entre los publicistas de que la prohibición de la discriminación racial, independientemente de los territorios, es una norma imperativa del derecho internacional". [168] Amnistía Internacional y Human Rights Watch también han caracterizado los asentamientos como una violación del derecho internacional.
A finales de enero de 2013, un informe elaborado por tres jueces, presidido por Christine Chanet , y emitido por el Consejo de Derechos Humanos de las Naciones Unidas declaró que los asentamientos judíos constituían una anexión progresiva basada en múltiples violaciones de las Convenciones de Ginebra y el derecho internacional, y afirmó que si Palestina ratificaba el Acuerdo de Roma , Israel podría ser juzgado por "graves violaciones de las normas de derechos humanos y graves violaciones del derecho internacional humanitario ". Un portavoz del Ministerio de Asuntos Exteriores de Israel declaró que el informe era "desafortunado" y acusó al Consejo de Derechos Humanos de la ONU de un "enfoque sistemáticamente unilateral y sesgado hacia Israel". [169]
La Corte Suprema de Israel , integrada por una variedad de jueces diferentes, ha declarado repetidamente que la presencia de Israel en Cisjordania viola el derecho internacional. [170]
Cuatro destacados juristas citaron el concepto de "vacío de soberanía" inmediatamente después de la Guerra de los Seis Días para describir el estatus legal de Cisjordania y Gaza: [171] Yehuda Zvi Blum en 1968, [172] Elihu Lauterpacht en 1968, [173] Julius Stone en 1969 [174] y 1981, [175] y Stephen M. Schwebel en 1970. [176] Eugene V. Rostow también sostuvo en 1979 que el estatus legal de los territorios ocupados era indeterminado. [177]
El profesor Ben Saul se opuso a esta opinión, argumentando que el artículo 49(6) puede interpretarse de modo que incluya las transferencias voluntarias o asistidas, como de hecho sucedió en la opinión consultiva de la Corte Internacional de Justicia que había expresado esta interpretación en la Opinión Consultiva sobre el Muro Israelí (2003) . [181]
Israel sostiene que el uso temporal de tierras y edificios para diversos fines es permisible bajo la excusa de la necesidad militar y que los asentamientos satisfacían necesidades de seguridad. [13] Israel sostiene que su política de asentamientos es coherente con el derecho internacional, incluida la Cuarta Convención de Ginebra , al tiempo que reconoce que algunos asentamientos se han construido ilegalmente en tierras privadas. [14] La Corte Suprema israelí ha dictaminado que el poder de la Administración Civil y del Comandante Militar en los territorios ocupados está limitado por las arraigadas normas consuetudinarias del derecho internacional público codificadas en el Reglamento de La Haya. [182] [183] [184] En 1998, el Ministro de Asuntos Exteriores israelí publicó "El documento de antecedentes de la Corte Penal Internacional". [185] En él se concluye que :
El derecho internacional reconoce desde hace tiempo que existen crímenes de tal gravedad que deben ser considerados "crímenes internacionales". Dichos crímenes han sido establecidos en tratados como la Convención sobre el Genocidio y las Convenciones de Ginebra... Las principales cuestiones que preocupan a Israel [es decir, con respecto a las normas de la CPI] son las siguientes: La inclusión de la actividad de asentamiento como un "crimen de guerra" es un intento cínico de abusar de la Corte con fines políticos. La insinuación de que el traslado de población civil a territorios ocupados puede ser clasificado como un crimen de igual gravedad que los ataques a centros de población civil o el asesinato en masa es absurda y no tiene base en el derecho internacional.
En 1998 se celebró en Roma una conferencia de las Naciones Unidas en la que Israel fue uno de los siete países que votaron en contra del Estatuto de Roma para establecer la Corte Penal Internacional . Israel se opuso a una disposición que incluía como crimen de guerra el traslado de poblaciones civiles a territorio ocupado por el gobierno. [186] Israel ha firmado el estatuto, pero no ha ratificado el tratado. [187]
Una enmienda de 1996 a una orden militar israelí establece que la tierra de propiedad privada no puede ser parte de un asentamiento a menos que la tierra en cuestión haya sido confiscada para fines militares. [153] En 2006, Peace Now obtuvo un informe, que según afirma fue filtrado de la Administración Civil del Gobierno israelí, que indica que hasta el 40 por ciento de la tierra que Israel planea retener en Cisjordania es de propiedad privada de palestinos. [188] Peace Now calificó esto como una violación de la ley israelí. [189] Peace Now publicó un informe completo sobre asentamientos en tierras privadas. [190] [191] A raíz de una batalla legal, Peace Now redujo la cifra al 32 por ciento, lo que la Administración Civil también negó. [192] El Washington Post informó que "el informe de 38 páginas ofrece lo que parece ser un argumento completo contra la afirmación del gobierno israelí de que evita construir en tierras privadas, basándose en los propios datos del estado para defender su argumento". [193]
En febrero de 2008, la Administración Civil declaró que las tierras en las que se había construido más de un tercio de los asentamientos de Cisjordania habían sido expropiadas por las FDI por "motivos de seguridad". [194] La propia Administración Civil definió la confiscación no autorizada de tierras palestinas privadas como "robo". [195] Según B'Tselem , más del 42 por ciento de Cisjordania está bajo el control de los asentamientos israelíes, el 21 por ciento de los cuales fue confiscado a propietarios palestinos privados, gran parte de ello en violación de la decisión de la Corte Suprema israelí de 1979. [127]
En 1979, el gobierno decidió ampliar los asentamientos o construir otros nuevos sólo en "tierras estatales". [84] [153]
Una base de datos secreta, elaborada por un oficial de alto rango retirado, Baruch Spiegel, por orden del ex ministro de defensa Shaul Mofaz , descubrió que algunos asentamientos considerados legales por Israel eran puestos de avanzada ilegales, y que grandes porciones de Ofra , Elon Moreh y Beit El se construyeron en tierras privadas palestinas. El "informe Spiegel" fue revelado por Haaretz en 2009. Muchos asentamientos se construyen en gran parte en tierras privadas, sin la aprobación del gobierno israelí. [196] Según Israel, la mayor parte de la tierra estaba vacía, fue arrendada al estado o comprada de manera justa a terratenientes palestinos.
La invocación de las Leyes de Propiedad de los Ausentes para transferir, vender o arrendar propiedades en Jerusalén Oriental que son propiedad de palestinos que viven en otros lugares sin compensación ha sido criticada tanto dentro como fuera de Israel. [197] Los opositores a los asentamientos afirman que las tierras "vacías" pertenecían a árabes que huyeron o colectivamente a una aldea entera, una práctica que se desarrolló bajo el dominio otomano . B'Tselem denunció que Israel está utilizando la ausencia de documentos legales modernos para las tierras comunales como base legal para expropiarlas. Estas "tierras abandonadas" a veces se blanquean mediante una serie de ventas fraudulentas. [198]
Según Amira Hass, una de las técnicas utilizadas por Israel para expropiar tierras palestinas es colocar las áreas deseadas bajo una clasificación de "zona de tiro militar" y luego emitir órdenes para la evacuación de los palestinos de las aldeas dentro de ese rango, mientras se permite que los asentamientos judíos contiguos permanezcan intactos. [199]
Amnistía Internacional sostiene que la política de asentamientos de Israel es discriminatoria y viola los derechos humanos palestinos. [200] B'Tselem afirma que las restricciones de viaje israelíes afectan a la libertad de movimiento de los palestinos [201] y que se han violado los derechos humanos palestinos en Hebrón debido a la presencia de colonos dentro de la ciudad. [202] [203] [204] Según B'Tselem, más del cincuenta por ciento de las tierras de Cisjordania expropiadas a los palestinos se han utilizado para establecer asentamientos y crear reservas de tierra para su futura expansión. Las tierras confiscadas benefician principalmente a los asentamientos y los palestinos no pueden utilizarlas. [205] Las carreteras construidas por Israel en Cisjordania para servir a los asentamientos están cerradas a los vehículos palestinos [206] [207] y actúan a menudo como una barrera entre los pueblos y las tierras en las que subsisten. [208]
Human Rights Watch y otros observadores voluntarios de derechos humanos presentan periódicamente informes sobre la "violencia de los colonos", en referencia a incidentes de apedreamiento y disparos en los que están implicados colonos israelíes. [209] La retirada de Israel de Gaza y Hebrón ha provocado violentas protestas de colonos y disputas por la tierra y los recursos. Meron Benvenisti describió la empresa de asentamientos como un "proyecto inmobiliario comercial que utiliza la retórica sionista para obtener beneficios". [210]
La construcción de la barrera israelí en Cisjordania ha sido criticada por considerarla una violación de los derechos humanos y territoriales de los palestinos. La Oficina de las Naciones Unidas para la Coordinación de Asuntos Humanitarios estimó que el 10% de Cisjordania quedaría del lado israelí de la barrera. [211] [212]
En julio de 2012, el Consejo de Derechos Humanos de las Naciones Unidas decidió abrir una investigación sobre los asentamientos judíos. En febrero de 2013 se publicó el informe de la misión internacional independiente de investigación que investigó las "consecuencias de los asentamientos israelíes para los derechos civiles, políticos, económicos, sociales y culturales del pueblo palestino en todo el territorio palestino ocupado". [213]
En febrero de 2020, la Oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos publicó una lista de 112 empresas vinculadas a actividades relacionadas con los asentamientos israelíes en la Cisjordania ocupada. [214] [215]
Los bienes producidos en los asentamientos israelíes pueden seguir siendo competitivos en el mercado global, en parte debido a los enormes subsidios estatales que reciben del gobierno israelí. Los agricultores y productores reciben asistencia estatal, mientras que las empresas que se establecen en los territorios reciben exenciones fiscales y subsidios gubernamentales directos. También se ha creado un fondo del gobierno israelí para ayudar a las empresas a pagar las multas aduaneras. [216] Los funcionarios palestinos calculan que los colonos venden bienes por un valor de unos 500 millones de dólares al mercado palestino. [217] Israel ha construido 16 zonas industriales, que contienen aproximadamente 1000 plantas industriales, en Cisjordania y Jerusalén Oriental en una superficie que ocupa grandes partes del territorio planificado para un futuro estado palestino. Según Jodi Rudoren, estas instalaciones afianzan la ocupación y proporcionan trabajo a los palestinos, incluso a los que se oponen a ella. Los 16 parques están ubicados en Shaked , Beka'ot , Baran, Karnei Shomron , Emmanuel , Barkan , Ariel , Shilo , Halamish , Ma'ale Efraim , Sha'ar Binyamin , Atarot , Mishor Adumim , Gush Etzion , Kiryat Arba y Metarim (2001). [218] A pesar de esto, los asentamientos de Cisjordania no han logrado desarrollar una economía local autosostenible. Alrededor del 60% de la fuerza laboral de los colonos se desplaza a Israel para trabajar. Los asentamientos dependen principalmente del trabajo de sus residentes en Israel propiamente dicho, en lugar de la fabricación local, la agricultura o la investigación y el desarrollo. De los parques industriales en los asentamientos, solo hay dos importantes, en Ma'ale Adumim y Barkan, y la mayoría de los trabajadores allí son palestinos. Solo unos pocos cientos de hogares de colonos cultivan tierras agrícolas y dependen principalmente de la mano de obra palestina para hacerlo. [219]
Los asentamientos tienen una dimensión económica, impulsada en gran medida por los costos significativamente más bajos de la vivienda para los ciudadanos israelíes que viven en asentamientos israelíes en comparación con el costo de la vivienda y la vida en Israel propiamente dicho. [58] El gasto gubernamental por ciudadano en los asentamientos es el doble del que se gasta por ciudadano israelí en Tel Aviv y Jerusalén , mientras que el gasto gubernamental para los colonos en asentamientos israelíes aislados es tres veces el promedio nacional israelí. La mayor parte del gasto se destina a la seguridad de los ciudadanos israelíes que viven allí. [59]
Según estimaciones del gobierno israelí, cada año se exportan a la UE productos de los colonos por un valor de 230 millones de dólares, entre ellos frutas, verduras, cosméticos, textiles y juguetes, lo que representa aproximadamente el 2% de todas las exportaciones israelíes a Europa. [216] Un informe de 2013 de Profundo reveló que al menos 38 empresas holandesas importaban productos de los asentamientos. [220]
La legislación de la Unión Europea exige que se haga una distinción entre los productos originarios de Israel y los procedentes de los territorios ocupados. Los primeros se benefician de un trato aduanero preferencial de conformidad con el Acuerdo de Asociación UE-Israel (2000) , mientras que los segundos no, al haber sido excluidos explícitamente del acuerdo. [216] [221] Sin embargo, en la práctica, los productos de los colonos a menudo evitan los trámites aduaneros obligatorios al estar etiquetados como originarios de Israel, mientras que las autoridades aduaneras europeas comúnmente no realizan los controles obligatorios del código postal de los productos para asegurarse de que no son originarios de los territorios ocupados. [216] [220]
En 2009, el Departamento de Medio Ambiente, Alimentación y Asuntos Rurales del Reino Unido emitió nuevas directrices relativas al etiquetado de los productos importados de Cisjordania. Las nuevas directrices exigen que el etiquetado aclare si los productos de Cisjordania proceden de los asentamientos o de la economía palestina. El Ministerio de Asuntos Exteriores de Israel dijo que el Reino Unido estaba "atendiendo las demandas de aquellos cuyo objetivo final es el boicot de los productos israelíes", pero el gobierno del Reino Unido lo negó y dijo que el objetivo de las nuevas regulaciones era permitir que los consumidores eligieran por sí mismos qué productos comprar. [221] Dinamarca tiene una legislación similar que exige que los productos alimenticios procedentes de los asentamientos de los territorios ocupados estén etiquetados con precisión. [216] En junio de 2022, Noruega también declaró que comenzaría a cumplir con la normativa de la UE para etiquetar como tales los productos procedentes de los asentamientos israelíes en Cisjordania y los Altos del Golán. [222]
El 12 de noviembre de 2019, el Tribunal de Justicia de la Unión Europea, en una sentencia [223] que abarca todo el territorio que Israel capturó en la guerra de 1967, decidió que las etiquetas de los productos alimenticios no deben dar a entender que los bienes producidos en territorio ocupado proceden del propio Israel y deben "evitar que los consumidores sean engañados en cuanto al hecho de que el Estado de Israel está presente en los territorios en cuestión como potencia ocupante y no como entidad soberana". En su sentencia, el tribunal dijo que no informar a los consumidores de la UE de que podrían estar comprando bienes producidos en asentamientos les niega el acceso a "consideraciones éticas y consideraciones relacionadas con la observancia del derecho internacional". [224]
En enero de 2019, el Dáil ( la cámara baja de Irlanda ) votó a favor, por 78 a 45, del proyecto de ley de Control de la Actividad Económica (Territorios Ocupados). [225] Esta ley prohíbe la compra de cualquier bien o servicio procedente de los asentamientos de los Altos del Golán , Jerusalén Oriental o Cisjordania . A fecha de febrero de 2019, el proyecto de ley tiene algunas etapas por completar; una vez codificado, una pena de cárcel de cinco años o multas de hasta 250.000 euros (284.000 dólares) afectará a quien infrinja esta ley. [226] [227] [228]
El 20 de febrero de 2022 se aceptó una petición presentada en septiembre de 2021 en el marco de la Iniciativa Ciudadana Europea . La petición busca la adopción de una legislación para prohibir el comercio con asentamientos ilegales. La petición requiere un millón de firmas de toda la UE y ha recibido el apoyo de grupos de la sociedad civil, incluido Human Rights Watch . [229] [230] [231] [232] [233]
En 2011, un informe palestino afirmaba que los asentamientos tienen un efecto perjudicial sobre la economía palestina, equivalente a alrededor del 85% del producto interno bruto nominal de Palestina, y que la "empresa de ocupación" permite al Estado de Israel y a las empresas comerciales sacar provecho de los recursos naturales y el potencial turístico palestinos. [234] Un informe de 2013 publicado por el Banco Mundial analizó el impacto que el acceso limitado a las tierras y los recursos de la Zona C tuvo sobre la economía palestina. Si bien los asentamientos representan un único eje de control, es el más grande, ya que el 68% de las tierras de la Zona C están reservadas para los asentamientos. El informe continúa calculando que el acceso a las tierras y los recursos de la Zona C, incluido el territorio dentro y alrededor de los asentamientos, aumentaría el PIB palestino en unos 3.500 millones de dólares (o el 35%) por año. [235]
El Tribunal Supremo de Israel ha dictaminado que las empresas israelíes tienen derecho a explotar los recursos naturales de Cisjordania para obtener beneficios económicos y que el derecho internacional debe "adaptarse" a la "realidad sobre el terreno" de la ocupación a largo plazo. [236]
Debido a la disponibilidad de empleos que ofrecen el doble del salario prevaleciente en Cisjordania (a agosto de 2013 [update]), así como al alto desempleo, decenas de miles de palestinos trabajan en asentamientos israelíes. [237] [238] Según la Asociación de Fabricantes de Israel , unos 22.000 palestinos estaban empleados en las industrias de la construcción, la agricultura, la manufactura y los servicios. [239] Un estudio de la Universidad Al-Quds en 2011 encontró que el 82% de los trabajadores palestinos dijeron que preferirían no trabajar en asentamientos israelíes si tuvieran un empleo alternativo en Cisjordania. [237]
Los palestinos han estado muy involucrados en la construcción de asentamientos en Cisjordania. En 2013, la Oficina Central Palestina de Estadísticas publicó una encuesta que mostraba que el número de trabajadores palestinos empleados en los asentamientos judíos aumentó de 16.000 a 20.000 en el primer trimestre. [238] La encuesta también encontró que los palestinos que trabajan en Israel y los asentamientos reciben más del doble de su salario en comparación con lo que reciben de los empleadores palestinos. [238]
En 2008, Kav LaOved denunció que a los palestinos que trabajan en los asentamientos israelíes no se les conceden las protecciones básicas de la legislación laboral israelí, sino que se les emplea con arreglo a la legislación laboral jordana , que no exige salario mínimo, pago de horas extras ni otros derechos sociales. La sentencia permitió a los trabajadores palestinos presentar demandas en los tribunales israelíes. En 2008, la suma media reclamada en esas demandas ascendía a 100.000 shekels. [240]
Según el Centro Palestino de Investigación Política y de Encuestas, el 63% de los palestinos se oponen a los planes de la Autoridad Palestina de enjuiciar a los palestinos que trabajan en los asentamientos. Sin embargo, el 72% de los palestinos apoyan un boicot a los productos que venden. [241] Aunque la Autoridad Palestina ha criminalizado el trabajo en los asentamientos, el director general del Ministerio de Trabajo palestino, Samer Salameh, describió la situación en febrero de 2014 como "atrapada entre dos fuegos". Dijo: "Desalentamos firmemente el trabajo en los asentamientos, ya que toda la actividad es ilegal e ilegítima... pero dada la alta tasa de desempleo y la falta de alternativas, no aplicamos la ley que criminaliza el trabajo en los asentamientos". [237]
Gush Emunim Underground fue una organización militante que operó entre 1979 y 1984. La organización planeó ataques contra funcionarios palestinos y la Cúpula de la Roca . [242] [243] En 1994, Baruch Goldstein de Hebrón, miembro de Kach , llevó a cabo la masacre de la Cueva de los Patriarcas , matando a 29 fieles musulmanes e hiriendo a 125. El ataque fue ampliamente condenado por el gobierno israelí y la comunidad judía. El liderazgo palestino ha acusado a Israel de "alentar y permitir" la violencia de los colonos en un intento de provocar disturbios palestinos y violencia en represalia. [244] La violencia perpetrada por colonos israelíes contra palestinos constituye terrorismo según el Departamento de Estado de los EE. UU., y el ex Jefe del Comando Central de las Fuerzas de Defensa de Israel, Avi Mizrahi, declaró que dicha violencia constituye "terrorismo". [245]
A mediados de 2008, un informe de la ONU registró 222 actos de violencia de colonos israelíes contra palestinos y tropas de las FDI, en comparación con 291 en 2007. [246] Se dice que esta tendencia aumentó en 2009. [247] El mayor general Shamni dijo que el número había aumentado de unas pocas docenas de individuos a cientos, y lo calificó como "un fenómeno muy grave". [246] En 2008-2009, el establishment de defensa adoptó una línea más dura contra los extremistas. [247] Este grupo respondió con una táctica llamada " etiquetado de precios ", vandalizando la propiedad palestina cada vez que se enviaba a la policía o soldados a desmantelar los puestos de avanzada. [248] Desde enero hasta septiembre de 2013, se registraron 276 ataques de colonos contra palestinos. [249]
Las principales figuras religiosas de Cisjordania han criticado duramente estas tácticas. El rabino Menachem Froman de Tekoa dijo que "atacar a los palestinos y sus propiedades es algo chocante... Es un acto que daña a la humanidad... Esto construye un muro de fuego entre judíos y árabes". [250] El Consejo de Yesha y Hanan Porat también condenaron tales acciones. [251] Otros rabinos han sido acusados de incitar a la violencia contra los no judíos. [252] En respuesta a la violencia de los colonos, el gobierno israelí dijo que aumentaría la aplicación de la ley y cortaría la ayuda a los asentamientos ilegales. [253] Se cree que algunos colonos atacan a los palestinos porque son "víctimas fáciles". [254] Las Naciones Unidas acusaron a Israel de no intervenir y detener a los colonos sospechosos de violencia. [255] En 2008, Haaretz escribió que "la sociedad israelí se ha acostumbrado a ver que los colonos que violan la ley reciben un trato especial y ningún otro grupo podría atacar de manera similar a las agencias de aplicación de la ley israelíes sin ser severamente castigado". [256]
En septiembre de 2011, los colonos destrozaron una mezquita y una base militar. Cortaron neumáticos y cables de 12 vehículos militares y pintaron grafitis. [257] En noviembre de 2011, la Oficina de las Naciones Unidas para la Coordinación de Asuntos Humanos (OCHA) en los territorios palestinos publicó un informe sobre la violencia de los colonos que mostraba un aumento significativo en comparación con 2009 y 2010. El informe se refería a la violencia física y los daños a la propiedad, como olivos arrancados, tractores dañados y ovejas sacrificadas. El informe afirma que el 90% de las denuncias presentadas por palestinos se han cerrado sin cargos. [258]
Según informes de la UE, Israel ha creado una "atmósfera de impunidad" para los atacantes judíos, lo que se considera equivalente a una aprobación tácita del Estado. En Cisjordania, los judíos y los palestinos viven bajo dos regímenes jurídicos diferentes y a los palestinos les resulta difícil presentar denuncias, que deben presentarse en hebreo en los asentamientos israelíes. [259]
En mayo de 2012, los 27 ministros de Asuntos Exteriores de la Unión Europea publicaron un informe en el que denunciaban enérgicamente las políticas del Estado de Israel en Cisjordania y denunciaban “la continua violencia de los colonos y las provocaciones deliberadas contra los civiles palestinos”. [260] El informe de todos los ministros de la UE instaba “al Gobierno de Israel a llevar a los autores ante la justicia y a cumplir con sus obligaciones en virtud del derecho internacional”. [260]
En julio de 2014, un día después del entierro de tres adolescentes israelíes asesinados , Khdeir, un palestino de 16 años , fue obligado a subir a un coche por tres colonos israelíes en una calle de Jerusalén Oriental . Su familia informó inmediatamente del hecho a la policía israelí , que localizó su cuerpo carbonizado unas horas más tarde en Givat Shaul , en el bosque de Jerusalén . Aunque la economía de los territorios palestinos ha mostrado signos de crecimiento, el Comité Internacional de la Cruz Roja informó de que el cultivo de olivos palestinos ha sufrido. Según el CICR, los colonos talaron o quemaron 10.000 olivos entre 2007 y 2010. [270] [271] El portavoz del Ministerio de Asuntos Exteriores, Yigal Palmor, dijo que el informe ignoraba los datos oficiales de la Autoridad Palestina que mostraban que la situación económica de los palestinos había mejorado sustancialmente, citando el comentario de Mahmoud Abbas al Washington Post en mayo de 2009, donde dijo que "en Cisjordania tenemos una buena realidad, la gente vive una vida normal". Haaretz culpó a un puñado de extremistas de la violencia durante la cosecha de aceitunas. [272] En 2010, se talaron, envenenaron o quemaron árboles pertenecientes tanto a judíos como a árabes. En las dos primeras semanas de la cosecha, 500 árboles propiedad de palestinos y 100 árboles propiedad de judíos fueron vandalizados. [273] En octubre de 2013, se talaron 100 árboles. [274]
Los ataques violentos contra los olivos parecen verse facilitados por la negativa aparentemente sistemática de las autoridades israelíes a permitir a los palestinos visitar sus propios olivares, a veces durante años, especialmente en los casos en que se considera que los olivares están demasiado cerca de los asentamientos. [275]
Los civiles israelíes [276] que viven en asentamientos han sido objeto de violencia por parte de grupos armados palestinos. Según Human Rights Watch, estos grupos afirman que los colonos son "objetivos legítimos" que han "perdido su condición de civiles al residir en asentamientos que son ilegales según el derecho internacional humanitario". [276] Tanto Human Rights Watch como B'tselem rechazaron este argumento sobre la base de que la condición jurídica de los asentamientos no tiene ningún efecto sobre la condición civil de sus residentes. [276] [277] Human Rights Watch afirmó que la "prohibición de los ataques intencionales contra civiles es absoluta". [276] B'tselem afirmó que "los colonos constituyen una población claramente civil, que tiene derecho a todas las protecciones que concede el derecho internacional a los civiles. El uso de tierras en los asentamientos por parte de las fuerzas de seguridad israelíes o la pertenencia de algunos colonos a las fuerzas de seguridad israelíes no afecta a la condición de los demás residentes que viven entre ellos, y ciertamente no los convierte en objetivos adecuados de ataque". [277]
Los ataques fatales contra colonos han incluido disparos de cohetes y morteros y tiroteos desde vehículos en movimiento , también dirigidos contra bebés y niños. Los incidentes violentos incluyen el asesinato de Shalhevet Pass , un bebé de diez meses abatido a tiros por un francotirador palestino en Hebrón, [278] y el asesinato de dos adolescentes por autores desconocidos el 8 de mayo de 2001, cuyos cuerpos fueron escondidos en una cueva cerca de Tekoa , un crimen que las autoridades israelíes sugieren que puede haber sido cometido por terroristas palestinos. [279] En el ataque con hacha de Bat Ayin , los niños de Bat Ayin fueron atacados por un palestino que blandía un hacha y un cuchillo. Un niño de 13 años murió y otro resultó gravemente herido. [280] El rabino Meir Hai , padre de siete hijos, murió en un tiroteo desde un vehículo. [281] [282] En agosto de 2011, cinco miembros de una familia fueron asesinados en sus camas. Las víctimas fueron el padre, Ehud (Udi) Fogel, la madre, Ruth Fogel, y tres de sus seis hijos: Yoav, de 11 años, Elad, de 4, y Hadas, la menor, un bebé de tres meses. Los activistas pro palestinos que realizan protestas periódicas cerca de los asentamientos han sido acusados de arrojar piedras, agredir físicamente y provocar. [286] [287] [288] En 2008, Avshalom Peled, jefe del distrito de Hebrón de la policía israelí , calificó de peligrosa y provocadora la actividad "de izquierdas" en la ciudad, y acusó a los activistas de antagonizar a los colonos con la esperanza de obtener una reacción. [289]
Las Asociaciones Ambientales Municipales de Judea y Samaria, un grupo de concienciación ambiental, fue establecido por los colonos para abordar los problemas de tratamiento de aguas residuales y cooperar con la Autoridad Palestina en cuestiones ambientales. [290] Según un informe de 2004 de Amigos de la Tierra Oriente Medio , los colonos representan el 10% de la población de Cisjordania, pero producen el 25% de la producción de aguas residuales. [290] Beit Duqqu y Qalqilyah han acusado a los colonos de contaminar sus tierras de cultivo y los aldeanos afirman que los niños han enfermado después de nadar en un arroyo local. El Ministerio de Medio Ambiente israelí emprendió acciones legales contra 14 asentamientos . La Autoridad Palestina también ha sido criticada por los ambientalistas por no hacer más para prevenir la contaminación del agua. [290] [291] Los colonos y los palestinos comparten el acuífero de la montaña como fuente de agua, y ambos generan aguas residuales y efluentes industriales que ponen en peligro el acuífero. Amigos de la Tierra Oriente Medio afirmó que el tratamiento de aguas residuales era inadecuado en ambos sectores. Se estima que las aguas residuales de origen palestino ascienden a 46 millones de metros cúbicos al año, y las de origen colono a 15 millones de metros cúbicos al año. Un estudio de 2004 concluyó que en muchos asentamientos las aguas residuales no se trataban lo suficiente, mientras que las aguas residuales de las aldeas y ciudades palestinas se vertían en pozos ciegos, arroyos y el medio ambiente abierto sin tratamiento alguno. En un estudio de 2007, la Autoridad de Naturaleza y Parques de Israel y el Ministerio de Protección Ambiental de Israel descubrieron que las ciudades y pueblos palestinos producían 56 millones de metros cúbicos de aguas residuales al año, de los cuales el 94 por ciento se descargaban sin un tratamiento adecuado, mientras que las fuentes israelíes producían 17,5 millones de metros cúbicos al año, de los cuales el 31,5 por ciento no se descargaban sin un tratamiento adecuado. Según los ambientalistas palestinos, los colonos operan plantas industriales y manufactureras que pueden generar contaminación, ya que muchas de ellas no cumplen las normas israelíes. [290] [291] En 2005, una antigua cantera entre Kedumim y Nablus estaba destinada a convertirse en un vertedero de residuos industriales. Los expertos en contaminación advirtieron que el vertedero amenazaría las fuentes de agua palestinas. [294]
El Consorcio para la Investigación Aplicada sobre la Migración Internacional (CARIM) ha informado en su perfil migratorio de 2011 para Palestina que las razones por las que las personas abandonan el país son similares a las de otros países de la región y atribuyen menos importancia a la situación política específica del territorio palestino ocupado. [295] Human Rights Watch informó en 2010 que las políticas de asentamiento israelíes han tenido el efecto de "obligar a los residentes a abandonar sus comunidades". [296] [297]
En 2008, Condoleezza Rice sugirió enviar refugiados palestinos a Sudamérica, lo que podría reducir la presión sobre Israel para que se retire de los asentamientos. [298] Sushil P. Seth especula que los israelíes podrían sentir que el aumento de los asentamientos obligará a muchos palestinos a huir a otros países y que el resto se verá obligado a vivir bajo los términos israelíes. [299] Hablando anónimamente con respecto a las políticas israelíes en las colinas del sur de Hebrón, un experto de la ONU dijo que la represión israelí sobre las infraestructuras de energía alternativa como los paneles solares es parte de una estrategia deliberada en el Área C.
"Desde diciembre de 2010 hasta abril de 2011, hemos visto un ataque sistemático a la infraestructura hídrica en Hebrón , Belén y el valle del Jordán . Ahora, en los últimos meses, están atacando la electricidad. Dos aldeas de la zona han visto demolidos sus postes eléctricos. Existe un esfuerzo sistemático por parte de la administración civil para atacar toda la infraestructura palestina en Hebrón . Aproximadamente 1.500 personas en 16 comunidades dependen de la energía producida por estas instalaciones. Las empresas de conductos están amenazadas con órdenes de paro laboral por parte de la administración israelí en su instalación de infraestructura de energía alternativa, y se espera que se emitan órdenes de demolición que oscurecerán las casas de 500 personas. La Universidad Ariel , antiguamente el Colegio de Judea y Samaria, es la principal institución de educación superior israelí en Cisjordania. Con cerca de 13.000 estudiantes, es la universidad pública más grande de Israel. La universidad fue acreditada en 1994 y otorga títulos de licenciatura en artes, ciencias, tecnología, arquitectura y fisioterapia. [302] El 17 de julio de 2012, el Consejo de Educación Superior de Judea y Samaria votó para otorgarle a la institución el estatus de universidad plena. [303]
Entre las escuelas de formación de profesores se encuentran el Herzog College en Alon Shvut y el Orot Israel College en Elkana . El Ohalo College está situado en Katzrin , en los Altos del Golán. [302] Los planes de estudio de estas instituciones están supervisados por el Consejo de Educación Superior de Judea y Samaria (CHE-JS). [304]
En marzo de 2012, el Consejo Regional de Shomron recibió el primer premio del Ministerio de Educación de Israel, el Premio Nacional de Educación, en reconocimiento a su excelencia en la inversión de recursos sustanciales en el sistema educativo. [305] El Consejo Regional de Shomron logró las calificaciones más altas en todos los parámetros (9,28 / 10). Gershon Mesika , el jefe del consejo regional, declaró que el premio era un certificado de honor para sus educadores y los jóvenes del asentamiento que demostraron su calidad y excelencia. [306]
En 1983, un plan del gobierno israelí titulado "Plan Maestro y Plan de Desarrollo para el Asentamiento en Samaria y Judea" preveía ubicar una "población judía lo más grande posible" en áreas prioritarias para lograr la incorporación de Cisjordania al "sistema nacional" israelí. [307] Según Ariel Sharon , las ubicaciones estratégicas de asentamientos funcionarían para impedir la formación de un estado palestino . [308]
Los palestinos sostienen que la política de asentamientos constituye un esfuerzo por impedir o sabotear un tratado de paz que incluye la soberanía palestina , y afirman que la presencia de asentamientos perjudica la capacidad de tener un estado viable y contiguo. [309] [310] Esta fue también la opinión del viceprimer ministro israelí Haim Ramon en 2008, diciendo que "la presión para ampliar Ofra y otros asentamientos no se deriva de una escasez de viviendas, sino que es más bien un intento de socavar cualquier posibilidad de alcanzar un acuerdo con los palestinos ..." El Ministerio de Asuntos Exteriores de Israel afirma que algunos asentamientos son legítimos, ya que surgieron cuando no había ningún acuerdo diplomático vigente y, por lo tanto, no violaron ningún acuerdo. [312] [313] [314] Sobre esta base, afirman que:
En 1982, como parte del tratado de paz entre Egipto e Israel, se produjo una de las primeras evacuaciones, cuando se exigió a Israel que evacuara a sus colonos de los 18 asentamientos del Sinaí. Las partes árabes en el conflicto habían exigido el desmantelamiento de los asentamientos como condición para la paz con Israel. La evacuación se llevó a cabo por la fuerza en algunos casos, por ejemplo en Yamit . Los asentamientos fueron demolidos porque se temía que los colonos pudieran intentar regresar a sus hogares después de la evacuación.
La retirada unilateral de Israel de la Franja de Gaza tuvo lugar en 2005. Implicó la evacuación de los asentamientos en la Franja de Gaza y parte de Cisjordania, incluidos los 21 asentamientos en Gaza y cuatro en Cisjordania, manteniendo al mismo tiempo el control sobre las fronteras, la costa y el espacio aéreo de Gaza. La mayoría de estos asentamientos existían desde principios de los años 1980, algunos tenían más de 30 años de antigüedad; [318] la población total involucrada era de más de 8.000 personas. [319] Hubo una oposición significativa al plan entre sectores de la población israelí, y especialmente entre los que vivían en los territorios. George W. Bush dijo que un acuerdo de paz permanente tendría que reflejar las "realidades demográficas" en Cisjordania con respecto a los asentamientos de Israel. [320]
El grupo israelí de derechos humanos GISHA sostiene que, a pesar de la retirada, Israel sigue ocupando Gaza porque mantiene su control sobre la zona. Por ejemplo, Israel mantiene el control sobre el espacio aéreo y las aguas de Gaza, sus fronteras (en concreto, el paso de mercancías y personas hacia y desde Gaza), el registro de población, sus redes de telecomunicaciones y la recaudación de derechos de aduana e impuestos sobre las importaciones. GISHA también informa de que Israel sigue controlando la infraestructura de Gaza mediante su control sobre el suministro de recursos como la electricidad. Además, en virtud del plan de retirada, Israel puede impedir que la Autoridad Palestina vuelva a abrir su aeropuerto o puerto marítimo. [321]
En los antiguos asentamientos, casi todos los edificios fueron demolidos por Israel, con excepción de algunas estructuras gubernamentales y religiosas, que fueron completamente vaciadas. En virtud de un acuerdo internacional, los invernaderos se dejaron para ayudar a la economía palestina, aunque los colonos habían demolido la mitad dos meses antes de la retirada. [322] La reducción del espacio para invernaderos y el aumento de las restricciones a las exportaciones redujeron la viabilidad del proyecto. [323] Después del redespliegue de las tropas israelíes a la frontera de Gaza, el 30% de los invernaderos sufrieron diversos grados de daño debido a que los saqueadores palestinos robaron, por ejemplo, mangueras y equipos de riego. [324] Después de la retirada, muchas de las antiguas sinagogas fueron incendiadas y destruidas por los palestinos. [325]
Algunos creen que no es necesario desmantelar y evacuar los asentamientos, incluso si Israel se retira del territorio en el que se encuentran, ya que pueden permanecer bajo el dominio palestino. Estas ideas han sido expresadas tanto por israelíes de izquierda [326] como por palestinos que abogan por la solución de dos Estados , y por israelíes de extrema derecha y colonos [327] que se oponen a cualquier desmantelamiento y reivindican vínculos con la tierra que son más fuertes que las fronteras políticas del Estado de Israel. El gobierno israelí ha amenazado en repetidas ocasiones con desmantelar los asentamientos de avanzada . Algunos de ellos han sido desmantelados, en ocasiones mediante el uso de la fuerza, lo que ha dado lugar a la violencia de los colonos .
Se dice que la negativa estadounidense a declarar ilegales los asentamientos fue el factor determinante en el intento de 2011 de declarar el Estado palestino en las Naciones Unidas, la llamada iniciativa Palestina 194. [328]
Israel anunció asentamientos adicionales en respuesta a la iniciativa diplomática palestina y Alemania respondió tomando medidas para detener las entregas a Israel de submarinos capaces de transportar armas nucleares. [329]
Finalmente, en 2012, varios estados europeos optaron por abstenerse o votar a favor de la condición de Estado en respuesta a la continua construcción de asentamientos. [330] Israel aprobó más asentamientos en respuesta a la votación, lo que provocó aún más condena mundial. [331]
Los asentamientos han sido una fuente de tensión entre Israel y los EE.UU. Jimmy Carter consideró que los asentamientos eran ilegales y tácticamente imprudentes. Ronald Reagan declaró que eran legales pero un obstáculo para las negociaciones. [332] En 1991, los EE.UU. retrasaron un préstamo subsidiado para presionar a Israel sobre el tema de la construcción de asentamientos en el corredor Jerusalén-Belén. En 2005, los EE.UU. declararon su apoyo a "la retención por parte de Israel de importantes centros de población israelíes como resultado de las negociaciones", [333] reflejando la declaración de George W. Bush de que un tratado de paz permanente tendría que reflejar "realidades demográficas" en Cisjordania. [334] En junio de 2009, Barack Obama dijo que los Estados Unidos "no aceptan la legitimidad de los asentamientos israelíes continuos". [335]
Los palestinos afirman que Israel ha socavado los acuerdos de Oslo y el proceso de paz al seguir expandiendo los asentamientos. Los asentamientos en la península del Sinaí fueron evacuados y arrasados a raíz del acuerdo de paz con Egipto . Los 27 ministros de asuntos exteriores de la Unión Europea publicaron un informe en mayo de 2012 en el que denunciaban enérgicamente las políticas del Estado de Israel en Cisjordania y concluían que los asentamientos israelíes en Cisjordania son ilegales y "amenazan con hacer imposible una solución de dos Estados". [260] En el marco del Acuerdo de Oslo I de 1993 entre el gobierno israelí y la Organización para la Liberación de Palestina (OLP), se llegó a un modus vivendi por el que ambas partes acordaron posponer una solución final sobre el destino de los asentamientos hasta las negociaciones sobre el estatuto permanente (artículo V.3). Israel sostiene que los asentamientos no fueron prohibidos en virtud de este acuerdo, ya que no hay una disposición provisoria explícita que prohíba la continuación de la construcción de asentamientos, pero sí se registra un compromiso de ambas partes, a saber, que "ninguna de las partes iniciará ni tomará medida alguna que cambie el estatuto de Cisjordania y la Franja de Gaza en espera del resultado de las negociaciones sobre el estatuto permanente" (artículo XXX1 (7)), lo que se ha interpretado como que no prohíbe los asentamientos, sino que impone severas restricciones a la construcción de nuevos asentamientos después de esa fecha. Las propuestas sobre el estatuto final han pedido que se mantengan las comunidades establecidas desde hace mucho tiempo a lo largo de la Línea Verde y que se transfiera la misma cantidad de tierra en Israel al Estado palestino. La administración Clinton propuso que Israel mantuviera algunos asentamientos en Cisjordania, especialmente los que se encuentran en grandes bloques cerca de las fronteras de Israel anteriores a 1967, y que los palestinos recibieran concesiones de tierra en otras partes del país. In November 2009, Israeli Prime Minister Netanyahu issued a 10-month settlement freeze in the West Bank in an attempt to restart negotiations with the Palestinians. The Palestinians refused to negotiate without a complete halt to construction.[353][354] In the face of pressure from the United States and most world powers supporting the demand by the Palestinian Authority that Israel desist from settlement project in 2010, Israel's ambassador to the UN Meron Reuben said Israel would only stop settlement construction after a peace agreement is concluded, and expressed concern were Arab countries to press for UN recognition of a Palestinian state before such an accord. He cited Israel's dismantlement of settlements in both the Sinai which took place after a peace agreement, and its unilateral dismantlement of settlements in the Gaza Strip. He presumed that settlements would stop being built were Palestinians to establish a state in a given area.[355]
The Clinton Parameters, a 2000 peace proposal by then U.S. President Bill Clinton, included a plan on which the Palestinian State was to include 94–96% of the West Bank, and around 80% of the settlers were to be under Israeli sovereignty, and in exchange for that, Israel will concede some territory (so called 'Territory Exchange' or 'Land Swap') within the Green Line (1967 borders). The swap would consist of 1–3% of Israeli territory, such that the final borders of the West Bank part of the Palestinian state would include 97% of the land of the original borders.[356]
In 2010, Palestinian Authority President Mahmoud Abbas said that the Palestinians and Israel have agreed on the principle of a land swap. The issue of the ratio of land Israel would give to the Palestinians in exchange for keeping settlement blocs is an issue of dispute, with the Palestinians demanding that the ratio be 1:1, and Israel insisting that other factors be considered as well.[357]
Under any peace deal with the Palestinians, Israel intends to keep the major settlement blocs close to its borders, which contain over 80% of the settlers. Prime Ministers Yitzhak Rabin, Ariel Sharon, and Benjamin Netanyahu have all stated Israel's intent to keep such blocs under any peace agreement. U.S. President George W. Bush acknowledged that such areas should be annexed to Israel in a 2004 letter to Prime Minister Sharon.[358][better source needed]
The European Union position is that any annexation of settlements should be done as part of mutually agreed land swaps, which would see the Palestinians controlling territory equivalent to the territory captured in 1967.[359] The EU says that it will not recognise any changes to the 1967 borders without an agreement between the parties.
Israeli Foreign Minister Avigdor Lieberman has proposed a plan which would see settlement blocs annexed to Israel in exchange for heavily Arab areas inside Israel as part of a population exchange.
According to Mitchell G. Bard: "Ultimately, Israel may decide to unilaterally disengage from the West Bank and determine which settlements it will incorporate within the borders it delineates. Israel would prefer, however, to negotiate a peace treaty with the Palestinians that would specify which Jewish communities will remain intact within the mutually agreed border of Israel, and which will need to be evacuated. Israel will undoubtedly insist that some or all of the "consensus" blocs become part of Israel".[358][better source needed]
A number of proposals for the granting of Palestinian citizenship or residential permits to Jewish settlers in return for the removal of Israeli military installations from the West Bank have been fielded by such individuals[360] as Arafat,[361] Ibrahim Sarsur[362] and Ahmed Qurei.[363] In contrast, Mahmoud Abbas said in July 2013 that "In a final resolution, we would not see the presence of a single Israeli—civilian or soldier—on our lands."[364]
Israeli Minister Moshe Ya'alon said in April 2010 that "just as Arabs live in Israel, so, too, should Jews be able to live in Palestine." ... "If we are talking about coexistence and peace, why the [Palestinian] insistence that the territory they receive be ethnically cleansed of Jews?".[365]
The idea has been expressed by both advocates of the two-state solution[326] and supporters of the settlers and conservative or fundamentalist currents in Israeli Judaism[327] that, while objecting to any withdrawal, claim stronger links to the land than to the State of Israel.
On 19 June 2011, Haaretz reported that the Israeli cabinet voted to revoke Defense Minister Ehud Barak's authority to veto new settlement construction in the West Bank, by transferring this authority from the Agriculture Ministry, headed by Barak ally Orit Noked, to the Prime Minister's office.[366]
In 2009, newly elected Prime Minister Benjamin Netanyahu said: "I have no intention of building new settlements in the West Bank... But like all the governments there have been until now, I will have to meet the needs of natural growth in the population. I will not be able to choke the settlements."[367] On 15 October 2009, he said the settlement row with the United States had been resolved.[368]
In April 2012, four illegal outposts were retroactively legalized by the Israeli government.[369] In June 2012, the Netanyahu government announced a plan to build 851 homes in five settlements: 300 units in Beit El and 551 units in other settlements.[370][371]
Amid peace negotiations that showed little signs of progress, Israel issued on 3 November 2013, tenders for 1,700 new homes for Jewish settlers. The plots were offered in nine settlements in areas Israel says it intends to keep in any peace deal with the Palestinians.[372] On 12 November, Peace Now revealed that the Construction and Housing Ministry had issued tenders for 24,000 more settler homes in the West Bank, including 4,000 in East Jerusalem.[373] 2,500 units were planned in Ma'aleh Adumim, some 9,000 in the Gush Etzion Region, and circa 12,000 in the Binyamin Region, including 1,200 homes in the E1 area in addition to 3,000 homes in previously frozen E1 projects.[374] Circa 15,000 homes of the 24,000 plan would be east of the West Bank Barrier and create the first new settlement blocs for two decades, and the first blocs ever outside the Barrier, far inside the West Bank.[375]
As stated before, the Israeli government (as of 2015) has a program of residential subsidies in which Israeli settlers receive about double that given to Israelis in Tel Aviv and Jerusalem. As well, settlers in isolated areas receive three times the Israeli national average. From the beginning of 2009 to the end of 2013, the Israeli settlement population as a whole increased by a rate of over 4% per year. A New York Times article in 2015 stated that said building had been "at the heart of mounting European criticism of Israel."[59]
United Nations Security Council Resolution 2334 "Requests the Secretary-General to report to the Council every three months on the implementation of the provisions of the present resolution;"[376][377]In the first of these reports, delivered verbally at a security council meeting on 24 March 2017, United Nations Special Coordinator for the Middle East Peace Process, Nickolay Mladenov, noted that Resolution 2334 called on Israel to take steps to cease all settlement activity in the Occupied Palestinian Territory, that "no such steps have been taken during the reporting period" and that instead, there had been a marked increase in statements, announcements and decisions related to construction and expansion.[378][379][380]
The 2017 Settlement Regularization in "Judea and Samaria" Law permits backdated legalization of outposts constructed on private Palestinian land. Following a petition challenging its legality, on June 9, 2020, Israel's Supreme Court struck down the law that had retroactively legalized about 4,000 settler homes built on privately owned Palestinian land.[381] The Israeli Attorney General has stated that existing laws already allow legalization of Israeli constructions on private Palestinian land in the West Bank.[382] The Israeli Attorney General, Avichai Mandelblit, has updated the High Court on his official approval of the use of a legal tactic permitting the de facto legalization of roughly 2,000 illegally built Israeli homes throughout the West Bank.[C] The legal mechanism is known as "market regulation" and relies on the notion that wildcat Israeli homes built on private Palestinian land were done so in good faith.[383]
In a report of 22 July 2019, PeaceNow notes that after a gap of 6 years when there were no new outposts, establishment of new outposts recommenced in 2012, with 32 of the current 126 outposts set up to date. 2 outposts were subject to eviction, 15 were legalized and at least 35 are in process of legalization.[384][385][386]
The Israeli government announced in 2019 that it has made monetary grants available for the construction of hotels in Area C of the West Bank.[387]
According to Peace Now, approvals for building in Israeli settlements in East Jerusalem expanded by 60% between 2017, when Donald Trump became US president, and 2019.[388]
On 9 July 2021, Michael Lynk, U.N. special rapporteur on human rights in the occupied Palestinian territory, addressing a session of the UN Human Rights Council in Geneva, said "I conclude that the Israeli settlements do amount to a war crime," and "I submit to you that this finding compels the international community...to make it clear to Israel that its illegal occupation, and its defiance of international law and international opinion, can and will no longer be cost-free." Israel, which does not recognize Lynk's mandate, boycotted the session.[389][390][391]
A new Israeli government, formed on 13 June 2021, declared a "status quo" in the settlements policy. According to Peace Now, as of 28 October this has not been the case. On October 24, 2021, tenders were published for 1,355 housing units plus another 83 in Givat HaMatos and on 27 October 2021, approval was given for 3,000 housing units including in settlements deep inside the West Bank.[392] These developments were condemned by the U.S.[393] as well as by the United Kingdom, Russia and 12 European countries.[394][395] while UN experts, Michael Lynk, Special Rapporteur on the situation of human rights in the Palestinian Territory occupied since 1967 and Mr. Balakrishnan Rajagopal (United States of America), UN Special Rapporteur on adequate housing said that settlement expansion should be treated as a "presumptive war crime".[396][397]
In February 2023, the new Israeli government under Benjamin Netanyahu approved the legalization of nine illegal settler outposts in the West Bank.[398] Finance Minister Bezalel Smotrich took charge of most of the Civil Administration, obtaining broad authority over civilian issues in the West Bank.[399][400] In March 2023, Netanyahu's government repealed a 2005 law whereby four Israeli settlements, Homesh, Sa-Nur, Ganim and Kadim, were dismantled as part of the Israeli disengagement from Gaza.[401] In June 2023, Israel shortened the procedure of approving settlement construction and gave Finance Minister Smotrich the authority to approve one of the stages, changing the system operating for the last 27 years.[402] In its first six months, construction of 13,000 housing units in settlements, almost triple the amount advanced in the whole of 2022.[403]
