En Filipinas , las provincias ( filipino : lalawigan o probinsiya ) son una de sus principales divisiones políticas y administrativas . En la actualidad, hay 82 provincias, que se subdividen a su vez en ciudades y municipios componentes . Las provincias se agrupan en dieciocho regiones en función de sus características geográficas, culturales y etnológicas. Trece de estas regiones se designan numéricamente de norte a sur, mientras que la Región de la Capital Nacional, la Región Administrativa de la Cordillera , la Región del Sudoeste de Tagalog (Mimaropa), la Región de la Isla de Negros y la Región Autónoma de Bangsamoro en el Mindanao Musulmán solo se designan mediante acrónimos.

Cada provincia es miembro de la Liga de Provincias de Filipinas , una organización que tiene como objetivo abordar cuestiones que afectan a las administraciones gubernamentales provinciales y metropolitanas. ^[1]

Gobierno

Un gobierno provincial es autónomo respecto de las demás provincias de la república. Cada provincia está gobernada por dos poderes electos principales: el ejecutivo y el legislativo. Los asuntos judiciales están separados del gobierno provincial y son administrados por la Corte Suprema de Filipinas . Cada provincia tiene al menos una rama de un Tribunal de Primera Instancia Regional .

Ejecutivo

El gobernador provincial es el jefe ejecutivo y jefe de cada provincia. Los gobernadores provinciales son elegidos por un período de tres años y están limitados a tres mandatos consecutivos y nombran a los directores de cada departamento provincial, que incluyen la oficina de administración, la oficina de ingeniería, la oficina de información, la oficina jurídica y la oficina del tesoro.

Legislativo

El vicegobernador actúa como presidente de cada Sangguniang Panlalawigan ( SP ; "Junta Provincial"), el órgano legislativo de la provincia. Cada SP está compuesto por miembros elegidos regularmente de los distritos provinciales, así como por miembros ex officio . El número de miembros elegidos regularmente del SP asignado a cada provincia está determinado por su clase de ingresos. Las provincias de primera y segunda clase cuentan con diez miembros regulares del SP; las provincias de tercera y cuarta clase tienen ocho, mientras que las provincias de quinta y sexta clase tienen seis. Las excepciones son las provincias con más de cinco distritos electorales, como Cavite con 16 miembros del SP elegidos regularmente, y Cebú , Negros Occidental y Pangasinan, que tienen doce cada una.

Cada SP tiene asientos designados para miembros ex officio , otorgados a los respectivos presidentes locales de la Asociación de Capitanes de Barangay (ABC), la Liga de Consejeros de Filipinas (PCL) y Sangguniang Kabataan ( SK ; "Consejo de la Juventud").

El vicegobernador y los miembros titulares de un SP son elegidos por los votantes de la provincia. Los miembros ex officio son elegidos por los miembros de sus respectivas organizaciones.

Relación con otros niveles de gobierno

Gobierno nacional

La Constitución filipina limita la intromisión nacional en los asuntos de cada gobierno provincial. Sin embargo, el Presidente de Filipinas se coordina con los administradores provinciales a través del Departamento del Interior y Gobierno Local . A los efectos de la representación nacional, cada provincia tiene garantizado su propio distrito congresual . Un representante del Congreso representa a cada distrito en la Cámara de Representantes . La representación senatorial se elige por mayoría simple y no se distribuye a través de distritos territoriales.

Ciudades y municipios

Las ciudades clasificadas como "altamente urbanizadas" o "componentes independientes" son independientes de la provincia, como se establece en la Sección 29 del Código de Gobierno Local de 1991. ^[2] Aunque dicha ciudad es una entidad autónoma de segundo nivel, en muchos casos se la suele presentar como parte de la provincia en la que está ubicada geográficamente, o en el caso de la ciudad de Zamboanga , la provincia de la que formó parte por última vez, la representación en el Congreso de .

Las unidades de gobierno local clasificadas como ciudades y municipios "componentes" están bajo la jurisdicción del gobierno provincial. Para garantizar que todos los gobiernos municipales o de ciudades componentes actúen dentro del alcance de sus poderes y funciones prescritos, el Código de Gobierno Local ordena al gobernador provincial que revise las órdenes ejecutivas emitidas por los alcaldes, y al Sangguniang Panlalawigan que revise la legislación del Sangguniang Panlungsod (Consejo Municipal) o del Sangguniang Bayan (Consejo Municipal) de todas las ciudades y municipios componentes bajo la jurisdicción de la provincia. ^[2]

Barangayes

El gobierno provincial no tiene relaciones directas con los barangays individuales. La supervisión del gobierno de un barangay es competencia del alcalde y del Sanggunian de la ciudad o municipio del que forma parte el barangay en cuestión. ^[2]

La clase de ingresos de una provincia determina el tamaño de la membresía de su Sangguniang Panlalawigan , y también cuánto puede gastar en ciertos artículos o adquirir a través de ciertos medios. ^[2]

Antiguas provincias

• Manila (hasta 1901) – Incorporada a Rizal ; partes alrededor de Manila se consolidaron posteriormente para formar la actual NCR .
• Lepanto-Bontoc (1902–1908) – Incorporada a la Provincia de Montaña .
• Provincia de Moro (1903-1913): se convirtió en el departamento de Mindanao y Sulu , compuesto por siete provincias. Actualmente forma parte de varias regiones de Mindanao.

• Kalinga-Apayao (1966–1995): dividido en Apayao y Kalinga . Kalinga conservó la capital provincial de Tabuk .
• Shariff Kabunsuan (2006-2008) – La Ley de la República Nº 9054 confirió a la Región Autónoma del Mindanao Musulmán poderes ampliados, especialmente la capacidad de crear provincias (Artículo VI, Sección 19). ^[41] Con base en esto, la Asamblea Legislativa Regional de la ARMM promulgó la Ley de Autonomía del Mindanao Musulmán Nº 201 el 28 de agosto de 2006. La Ley creó una nueva provincia, que comprende todos los municipios del primer distrito del Congreso de Maguindanao (excepto la ciudad de Cotabato ), con su capital en Datu Odin Sinsuat . La creación de la provincia fue aprobada el 28 de octubre de 2006, por mayoría de votos en un plebiscito . En respuesta a las solicitudes de aclaración sobre qué distritos del Congreso forman Shariff Kabunsuan para las elecciones de 2007 (específicamente si la ciudad de Cotabato era parte de la representación de la nueva provincia), COMELEC emitió la Resolución No. 7845 , que inicialmente sostuvo que la ciudad de Cotabato era la única LGU restante en el Primer Distrito de Maguindanao. • Maguindanao (1973-2022) – La Ley de la República N° 11550 ^[43] dividió la provincia en Maguindanao del Norte y Maguindanao del Sur mediante un plebiscito. Maguindanao del Norte se parece a la antigua provincia de Shariff Kabunsuan, sin embargo, agrega el municipio de Sultan Sumagka a su territorio. • Leyte Occidental y Leyte Oriental (1923) – Leyte fue dividida en dos nuevas provincias por la Ley Nº 3117 el 27 de marzo de 1923. ^{[149] Sin embargo, la división nunca se llevó a cabo, ya que el} Gobernador General no emitió ninguna proclamación .

• Maranaw (1971) – La Ley de la República No. 6406 , ^[151] que buscaba crear una nueva provincia a partir del este de Lanao del Sur (que ahora corresponde al primer distrito del Congreso de la provincia ), fue aprobada el 4 de octubre de 1971. La provincia estaría compuesta por los municipios de Bubong , Ditsaan-Ramain (incluido lo que ahora es Buadiposo-Buntong ), Kapai , Lumba-Bayabao (incluido lo que ahora es Maguing ), Marantao , Masiu , Mulondo , Saguiaran , Piagapo , Poona Bayabao , Tamparan , Taraka y Wao (incluido lo que ahora es Bumbaran ), con la ciudad autorizada de Marawi como capital de la nueva provincia. • Isabela del Norte e Isabela del Sur (1995) – El 20 de febrero de 1995 se aprobó la Ley de la República Nº 7891 ^[152] , que pretendía dividir la provincia de Isabela . Isabela del Norte comprendería los municipios pertenecientes al primer y segundo distritos congresuales de la provincia, con Ilagan como capital. Isabela del Sur consistiría en el tercer y cuarto distritos congresuales (excluyendo la ciudad componente independiente de Santiago ), con Cauayan como capital. La división propuesta fue rechazada en un plebiscito celebrado el 20 de junio de 1995.
• Quezón del Norte y Quezón del Sur (2007) – La ley que dividía la provincia de Quezón en dos, la Ley de la República No. 9495 , ^[153] caducó sin la firma del Presidente el 7 de septiembre de 2007. Quezón del Norte (que pasaría a llamarse Quezón) iba a estar compuesta por el primer y segundo distritos del Congreso de la provincia, con Lucena como su capital. Quezón del Sur, con su capital en Gumaca , habría estado compuesta por el tercer y cuarto distritos del Congreso . La COMELEC celebró el plebiscito el 13 de diciembre de 2008, y la mayoría de los votos rechazaron la división. A pesar del rechazo de los votantes, todos los representantes de los cuatro distritos legislativos de Quezón —Wilfrido Mark Enverga, Irvin Alcala, Danilo Suárez y Lorenzo Tañada III— volvieron a presentar la medida como Proyecto de Ley de la Cámara de Representantes N.° 3839 el 8 de diciembre de 2010. • Palawan del Norte , Palawan Oriental y Palawan del Sur (2021) – El 5 de abril de 2019, el presidente Rodrigo Duterte firmó la Ley de la República No. 11259 que proponía la división de la provincia de Palawan, con excepción de la ciudad independiente de Puerto Princesa , en tres provincias separadas. Un plebiscito estaba originalmente programado para el segundo lunes de mayo de 2020 ^[156] pero se pospuso hasta marzo de 2021 debido a la pandemia de COVID-19 . ^[157] Palawan del Norte habría estado compuesta por Taytay y municipios al norte de ella. Palawan del Sur habría estado compuesta por los municipios al oeste y al sur de Puerto Princesa, incluido Kalayaan (que administra las reclamaciones del país en las Islas Spratly ), mientras que se propuso que el resto formara Palawan Oriental. Provincias propuestas actualmente en el 19° Congreso

• Surigao Oriental (1992, 2015, 2022): El proyecto de ley de la Cámara de Representantes n.º 2336 busca crear una provincia a partir de las seis unidades de gobierno local más al sur de la provincia de Surigao del Sur . La ciudad de Bislig y los municipios de Barobo , Hinatuan , Lingig y Tagbina comprenden el distrito del autor del proyecto de ley, el representante del segundo distrito de Surigao del Sur, Johnny T. Pimentel ; el proyecto de ley también busca transferir Lianga , actualmente parte del primer distrito, a la provincia propuesta. Bislig sería la capital designada. • Zamboanga Occidental (2002, 2007, 2010, 2017, 2023) – El 25 de septiembre de 2023, el representante del tercer distrito de Zamboanga del Norte , Adrian Michael A. Amatong, presentó el Proyecto de Ley No. 9311 que busca crear una nueva provincia a partir de su circunscripción. Otras provincias propuestas

• Mindoro del Sur (1998): Durante el 11.º Congreso, el representante del 1.º distrito de Mindoro Oriental , Renato Leviste, presentó el proyecto de ley de la Cámara de Representantes n.º 1476, en el que proponía convertir el 2.º distrito adyacente en su propia provincia llamada Mindoro del Sur. La provincia propuesta habría consistido en los siete municipios que forman la mitad sur de Mindoro Oriental : Bansud , Bongabong , Bulalacao , Gloria , Mansalay , Pinamalayan y Roxas . • Bukidnon del Sur (2004): En noviembre de 2004, durante el XIII Congreso, el representante del tercer distrito de Bukidnon , Juan Miguel F. • Cebú del Norte , Cebú del Sur y Cebú Occidental (2005): Durante el 13.º Congreso, la provincia de Cebú se enfrentó a la denominada controversia Sugbuak . En enero y febrero de 2005, el representante del segundo distrito Simeon L. Kintanar, el representante del tercer distrito Antonio P. Yapha, Jr. y el representante del cuarto distrito Clavel A. Arnulfo Fuentebella introduced House Bill 4728, which sought to create a new province out of the City of Iriga and 16 municipalities comprising the eastern half and the southern portion of Camarines Sur.^[190] This would have included all 10 municipalities of Fuentebella's Fourth District (Caramoan, Garchitorena, Goa, Lagonoy, Presentacion, Sagñay, San Jose, Siruma, Tigaon, and Tinambac) and all six municipalities of the adjacent Fifth District (Baao, Balatan, Bato, Buhi, Bula, and Nabua). Tigaon would have been the capital of the proposed province.^[191] Just three months later, on August 3, 2011, the finalized measure numbered House Bill No. 4820 passed the House of Representatives of the Philippines with 229 votes in favor to one against.^[192][193] However, it failed to gain the concurrence of the Senate, which did not take up the controversial bill by the end of 15th Congress, following the opposition of Senators Joker Arroyo, Antonio Trillanes IV, Bongbong Marcos and Manny Villar.^[194] In 2015, Rappler reported: “It is widely believed here that the Fuentebellas want a new province they can rule because they had failed to win the governorship of Camarines Sur since former Governor Luis Villafuerte held the position.”^[195]

Proposed renaming

• Southern Leyte to Leyte del Sur (2007)  – Southern Leyte Lone District Rep. Roger Mercado introduced bills to rename the province of Southern Leyte to Leyte del Sur, citing a desire to “enhance the identity of [the province] as geographically a part of the Leyte Island with a distinct personality of its own” and to have the province alphabetically listed closer to the neighboring province of Leyte, from which it was separated in 1959.^[196] Mercado first filed the bill in 2007,^[197] and this attempt gained traction during the 14th Congress, as House Bill No. 6650 was passed by the House of Representatives on September 8, 2009, with 170 votes in its favor and none against it. The Senate, however, did not act on the measure.^[198] Mercado's second attempt in 2017 did not prosper, as House Bill No. 1602 died in the committee level during the 17th Congress.^[199]

     5. The Province of Romblon is abolished and the municipalities comprising the same as well the territory thereof shall be annexed to the of Capiz."^[119]
